A big question is finally answered
Man! A big question was just answered. Eric Bellas was explaining his case. He said Emily died Dec. 29, 2005. She followed Jerry to the remote pasture and Jerry shot her, twice, once in the front and once in the back. Then, he loaded her into the toolbox and went back to the farm. He asked the workers to clean the front-end loader and wash away the evidence, Bellas said. Then, he had Antonio drove him to the entrance of the pasture with a black garbage bag, not full, but stuff in it, Bellas said. He loads the truck into an equipment trailer and takes the trailer hooked up to the red Ford F350 that Jerry typically drove and goes to South Carolina. He's on the road, Bellas says, between 12:04 and 4:30. He stops at a truck stop, unloads Emily's truck and parks it at the Waffle House. He then drives back to Sawmills, drops off the trailer and fills his 350 up with gas at PD. He then proceeds to the dinner party to go on with his life. Between then and his arrest, he plans an alibi, Bellas says. He tells Antonio to tell law enforcement he was at the farm. He has Jose re-date the oil filters so Jose can say he and Jerry were changing them on Dec. 29 and he worries about Emily's cell phone, Bellas said. Because Jerry got rid of her purse; he got rid of the murder weapon, but he forgot the cell phone, and he was worried it was in the field. That's way, Bellas says, he asked the workers to look in that pasture for the cell phone. There's only one question, Bellas says, and Jerry answered it. When talking to Maj. Stafford before Jerry's arrest, Stafford tells Jerry we have a lot of evidence. And Jerry says, "And it all points to me." Those were the words on Bellas' PowerPoint presentation when he finished just now. So, we finally got an explanation of how Jerry got back from South Carolina. I've been waiting since Jan. 27, 2006, Jerry's arrest, to get some explanation. Interesting...
Well, we took an early break. When we get back, the judge will go over court instructions with the jurors and then they will be handed the case. I would guess within the hour. We will probably still break for lunch at 12:30, but you never know what the judge will decide. I will be back in a little bit.

Does anyone know about the toobox and if it was locked all the time? And if it was, who all had a key? Has this been brought up at all?
If Jerry did as Bellas had presented-this is a very cold man
is this theory about how jerry got back fron SC kinda strange ? wouldn't that big red truck pulling a trailer with a white truck on a trailer behind it be kind of obvious going down the road ? Moreover wouldn't someone in SC have seen jerry unload the truck ? Just Questions ?

sawmillman-very good question-was this an enclosed trailer that supposibly carried E's truck to SC? And I just said the same thing to my co-worker-"wouldn't someone in SC noticed Jerry unloading a truck" Truck stops are generaly very busy places as Waffle Houses are-seems someone would have come forward by now. Oh well, this goes on my list of unanswered question of how Jerry pulled this off without someone helping him.
Are you kidding me? This is the first time the state has brought up an equipment trailer used in this "crime". Do they know anything about it or have any witnesses that saw it hooked to Jerry's truck? Sounds like another fairy tale from the prosecution. Maybe the CCSD will get to checking out the trailer in the next 12-18 months?
Another question how far is this so called truck stop away from the waffle house ? How long did it take him to unload the truck take it and park it and then get back to his own Truck ? The DA has really screwed this case up bad !!

Talk about pure speculation on the part of Bellas--If this the way it happened then why did he not prove that in court. He just laid a theory out and hope the jury buys into it. I have read no testimony anywhere that mentioned the big red truck. Besides think about this folks--Big truck pulling a trailer big enough to hold another truck inside of it doing more than 55 to 60 miles per hour tops and he goes to Duncan, SC and back in less than 4 hours. I do not know how far that is but I've seen some comments on here that said it was 100 miles. If you take into account the time he spent when he got there unloading the truck from the trailer and other possible things there is no way. Just figure doing an average speed of 55 miles per hour--that is 3.63 hours of just driving. The other thing is that if he pulled up to the area where the truck was found and unloaded the truck there is no way he could do this and someone not see something or him especially if he does this and just drives off. It was broad daylight and I do not buy it. The other part is when he asked the workers to clean up the bucket on the tractor do you not think there would have been some blood in the bucket they would have noticed. I did hear or read anywhere where the workers testified to seeing any blood. Give Bellas credit for getting this in the jurors minds and it could be what they were waiting to hear even if it is only a last grasping theory for a DA that never proved it during the trial.
I do-and it will be "not guilty"-just from the lack of evidence the CCSD & Prosecution team presented. Someone (maybe the Gov.) should really look at this case. ? if the verdict is not guilty-can the prosecution appeal?
No appeal get real . he cannot be tried for the same crime twice .
But if there is a hung jury or the jury can not reach a verdict what happens?
I think in the case of A hung jury the state can reprepare an try him again but i am not 1oo percent sure on this .
If the jury accepts this theory, then they've totally discounted Both forensic experts who say Emily was only dead from 2-4 days. One of these experts was the states own witness. One expert, maybe, but 2? If Bellas believed his own theory, he'd give us an explanation for the 2-4 days. He's counting on the statement that "it's possible but unlikely, that Emily was dead up to 10 days". Sounds lame to me.

The hung jury would be the best the state could hope for--they then could keep the case open and if they still find after more investigation the killer is Jerry they can charge him again with the same charges. However, if it is a hung jury I'm sure the defense will ask for bail for their client if the state indicates in court they are going to pursue the case against him again and want him held without bond. I would bet the jury would grant him bond and if he is guilty then he will disappear. Of course they would insure they have his passport so he could not leave the country. I still think this jury will find him guilty but not sentence him to death.

Sorry sawmillman, by law either side can appeal. If the court, the defense, the DA or a juror committed error, it is proven to be prejudicial to the state and but for such error the jury would have reached a different verdict, the state may have grounds to appeal. It's very far fetched and I cannot tell you the last time I know or have read of that happening. The state would not be appealing the verdict as much as the trial and the way it was handled. In this case, Gaither would be better served to let sleeping dogs lie. The state has made many evidentiary and procedural blunders that our appeallant courts would consider prejudicial, regardless of the outcome.
I am amazed at the state's ability to argue, I am assuming with a straight face, to the jury facts otherwise not in evidence. This is like a bad trip to Wonderland for this jury. I agree with everyone's observations about the big red truck. There were security cameras at the waffle house and the motel and if the big red truck ever appeared in any of the films collected after the fact, we will never know because the Sheriff's Department not only lost the film but the lead investigator never looked at them!
If Jerry murdered his wife with deliberation and premeditation, by shooting her at his residence, engaging the help of workers at the farm, leaving town driving a truck while pulling another, blah, blah, blah.........then he is the dumbest of crooks. Why would a person commit such a deliberate act except in secret? This method is not that of a cold blooded killer but an idiot just begging to be caught.
I predict a quick verdict if for no other reason than the jury has been "held" for almost 2 months. I am certain they are ready to resume their normal lives. Unless the jury just enjoys each other's company which I do not believe to be the case for all members, they will be anxious to say bye, bye!
Wow, I can't believe the District Attorney presented that hooey with a straight face. Where is the testimony to back up the truck scramble theory? It is totally made up just like I could make up that aliens did this crime.
I didn't think the DA was allowed to do that. Maybe they should have to put their hand on the Bible too.

And besides, what about the phone call from Dallas? How does that fit in? Ooops, they forget to work that into this fabrication.

ok, so this is what i think when trying to envision jerry unloading this truck. he very well could have hauled it to sc with his big red truck, he then could have unloaded it form some where wlse and then drove it to the parking lot at the waffle house, got out and flattened the tire. as far as the gun and emily's purse, it could be any where, and when i mean anywhere, he could have stopped and slung it out the window in a creek or in a ditch, or even barried it somewhere! Who nows, it could be form here to eternity! has anyone questioned about the brown van someone supposedly seen pull up to e's truck, get out, and mess in it and then lock it and the leave again in the brown van. could this be the stranger that is being accused of taking emily? could this be the man who unknowingly helped a man who he thought was in trouble that could have asked him for a ride to his truck that had a flat tire???
so many questions still unanswered, but with what i just read on here about how it happened, if i was on the jury i think i would vote guilty all the way.
i know i have posted numerous posts about things and sometimes at first i thought it could be either way and that just maybe emily's lasts breath was not staring at her husband jerry but at a complete stranger, shooting her.
but then i thought it had to be him fo rmany reasons. the 4.5 million dollars, the debt, the new farm, the supposed girlfriends, what ever it may be, made him look guilty as sin. but then last week the defense put up a hell of a fight and it made him look not guilty!
But after this morning, I have totally changed my mind and i am voting guilty all the way!
Allison the law in this county is scarce to say the least . I live in caldwell county and this has got to be one of the worst law enforcemnet agencies i have ever seen . The only way they can catch a criminal is if the person confess's .

are you kindin' he used dry ice to keep her cold so it would delay decomp. and who says he drove her, a man set to get millions in life insurance could pay someone to drive her. were all his farm hands talked to or were some missing. thats why others say they saw her as well so they can get a cut of the insurance money. also with the paint chips on her back from the front end loader there is no way she went that long with paint on her back( if she was alive--not!)

The first mistake was to move a vehicle from a crime scene without having it processed first. Just how many mistakes were made in this case? Just how much evidence was lost during the move of that vehicle. If they didn't realize Emily was in the truck, how many more things did they miss before they blew off the truck during the move?

If you go across the Connelly Springs road and cross Mineral Springs mountain you can be on 85 in SC and to Duncan in less than an 1 hour and 45 minutes.
Also I drove a truck for years, there's so much going on in truck stops nobody would pay any attention to someone unloading this pickup there.

There is a rumor in our community about Kathy Ramsey and Jerry Anderson having an affair. Everyone thinks her behavior and intense interest in Jerry Anderson is a bit odd, after she was thrown out of the courtroom today, the rumor is gaining credibility.
