Poor Jerry, poor Emily. This is worse than not even having a trial at all. At least if JA had not been arrested and tried one would hope officials would still be searching for the murderer. Now it's just back to square one, or in the prosecution's case, square negative 50.

That was his only option. It is sad that there was no conclusion for any of the families involved. I would like to know what the break down is myself.

GERTIE the man deserves bond . Get this a jury of his peers couldn't even be 100 percent sure he was guilty !

The state could offer him a deal now, but I feel he would be wrong to take it. Even if he did do it, the state needs new evidence to convict, and from what I have read and heard they do not have it to prove beyond a reasonable doubt.

Sawmill man - until the prosecution decides if they are going to retry him or not he should stay locked up. They couldn't agree on a verdict, they didn't say he was not guilty. Nothing has changed - except to drag this out longer.

Double Jeopardy - he can not be tried again and as previously stated he could not be tried on a lesser charge either. He will be home tonight.

It is not double jeopardy. There was no verdict. The state will now have to decide if they will retry. If he couldn't be tried again they wouldn't have to ask for bail.

soccerjox help me out here - double jeopardy applies if they'd found him not guilty. They didn't render a verdict, so he can still be retried, am I right?

I think they should set him free now. The state has not proved their case. I think the defense proved more in his innocence than the state did in his presumed guilt!

Sawmill man: I know that, but he has been locked up since he was arrested. Nothing has changed. He didn't get bond before for a valid reason, the reason still exists.

I know everyone wants this over but I for one feel that the families and the community both could have a more complete closure if there wasn't so many unanswered questions. If it ends like this then there will always be speculations and accusations no matter what the verdict.

By the way- does anyone know if the charges stay the same if JA is retried? Is it possible that the prosecution can seek a "lesser" charge like 2nd degree murder or manslaughter, like some of the bloggers have mentioned or must he still face the death penalty if convicted of murder one?

You don't have to be wealthy to be a flight risk - You just have to have good friends to help you out. Say, like the Ramsey's. I wasn't the judge who denied bond the first time. Why don't you ask him?

He was denied bond before because of the threats he supposedly made against the mexicans who worked for him and their families.

Gertie what makes you think JA is a flight risk . A jury couldn't come to a decision in this trial. If you were JA wouldn't you like your chances in a second trial . Ecspecially with The wonderful investigators we have here in caldwell county !

Maybe the flight risk was due to his plans to move to TN? As far as taking my chances -I guess that would depend on the which way had the majority vote, even though we may have our speculations!!

It is doubtful that a breakdown of the jurys' votes will be disclosed. Bringing out that information would inevitably taint the next jury. The judge will more than likely keep that information between him and the jurors. As for the question about if JA has the right to be released on bond: Did the state prove that he committed murder? Have that given any key or pertinent evidence that Jerry had anything to do with Emily's murder? Theres no murder weapon, no witnesses (to murder), no substantial evidence whatsoever to hold the man inside a jail cell any longer. He should be released on bond and retried at a later date. But the end result will be the same--no jury could possibly convict any man of murder on the evidence that the so called "investigators" have collected in this case. The next jury will have to acquit, just as this one should have.

I think they would have been kinder to Emily's family - out of respect for Emily - had they truely been her friends. That relationship turned sour before Jerry was even arrested. Granted, I just know one side, but it doesn't paint a good picture of them.

Double Jeopardy does not apply in this case. As long as there is not a verdict and if the DA feels they have proven their case they can retry him as many times as they feel is necessary to get a conviction. Double jeopardy only applies if the verdict is handed down as not guilty. Now the DA can come back and retry him on the original charge, with the Death Penalty, the original charge with Life without the possibility of parole or they can come back and try him now on a lesser charge to get a conviction. It really depends on what they get from the Jury. If the Jury comes back as 11 - 1 then the DA would be a moron to retry this case with out more concrete evidence.

Ok everyone calm down, I know that everyone is upset about this and you have a right to be, attacking each other isn’t going to bring closure to any of the families.

If this goes to trial again I hope BOTH sides dig deeper and fill in the blanks. I would think this will prove much more difficult for the prosecution as the evidence is now almost 2 yrs old, but both sides have the advantage of being familiar with one another's tactics. They will have to stick to the hard facts and each try to stay ahead of the other.

Gertie... once the jurors are relieved of their duty, they are no longer subject to the rules of any judge or law entity.

Once the Judge release them from thier duties they can write a book if they want to explaining everything. I am willing to bet that they will disclose the votes, not who voted how but the breakdown.

Gertie, there will not be any answers today. I am not sure what the DA is going to do. I would not expect him to divulge much about the case or what he is going to do. If I were all of you in the area I would keep my nose in the local new reports I am sure there will be a press conference of something by the Defense or at a minimum some news on the case.

Even if Jerry is released it is on a bond. A 150,000 dollar bond. First someone is going to have to make that bond for him!

Second, if he gets the bond granted, he will be out on strict rules and regulations! So if the man wants to run someone will be paying all that bond money back!

And let's face it, no one in their right mind wants to pay back $150,000 dollars. Especially not anyone from Sawmills!

Third, at this point if the DA does not drop the charges, this man could still be looking at some prison time!

He very well good be charged again, and this time, whether it is months or weeks, or even days later, something may come out of the wood works and be found that holds him true to the crime!

And last but not least, this is to the sawmills man, are you an ass kisser to Mr. Anderson, or are you just an old friend still wanting to be his friend because all this money is hanging in the balance, and you think that if Jerry gets out, he will share this with you!!!

Hard to believe, but this man has done a great job of not only lying to everyone but making them believe he didn't kill his wife Emily!

This is my opinion about it. First of all I wouldn't doubt it if you were a Ramsey on here saying what you have said all this time. Taking up for a guilty man! And let me tell you, Ramsey doesn't have alot to hang with it, based on they are just as big as liars and cheaters as Jerry Anderson is!

Well, let's just say you got your wish, the man will be free pretty soon indeed! But do not htink that Jerry's time will not come in the end! God has watched all this time and in the end he just very well may burn in hell! He thinks serving prison time is harsh, the reins of hell will be no match!

This man derserves to burn in hell!
