Stafford: rape kit not sent off because there were no signs of sexual assault

All right. We have heard a lot of testimony in the last 90 minutes. I think I am going to go through and bullet point some key things.
* Investigators were told Emily had up to $2,000 the day she went missing. However, attorneys were not able to account that money. When they found Emily, she had $30 on her.
* Stafford said he asked for a rape kit from the medical examiner, which he said it's routine. However, since there were no signs of sexual assault, the rape kit was never sent off. No signs of sexual assault included she was not undressed, her zipper was zipped, her cell phone was on her side.
* Investigators believe Emily was found in the same clothes she went missing in. But Dubs asked Stafford if he knew Emily wore those boots every day. He didn't ask anyone. Nor did he ask anyone if Emily wore that Old Navy sweatshirt every day. He also didn't get what type of jeans Emily was reported missing and jeans she was found in. Stafford honestly believes Emily was in the exact same clothes.
* Several times (again) Stafford said he should have gone to Duncan, S.C, to interview people. He just didn't do it. He realized he should have done it when this trial started - mostly because the defense asked so many questions.
* Capt. Brackett made the decision to have McNeil do the dog search. Investigators did not use cadaver dog handlers in cases before. They did not check McNeil's credentials.
* Dubs asked Stafford if the reason he prayed with Jerry on the afternoon of Jan. 18, 2006, was a tool. Stafford said no. He said he is a Christian man and Jerry is a Christian, so he wanted to pray together.
Dubs is still asking questions of Stafford. I bet he'll be on the stand all day. Bellas will surely re-direct then Dubs will more than likely have more questions.

I honestly believe Dubs is reading this site either in the courtroom via wireless or someone working for her is--Did you see where she asked Stafford about his praying with Jerry if it was a tool and he said no--I just mentioned that in an earlier comment this morning--maybe just happen stance or maybe she is that good--i believe i would have asked the question a little different to get the jurors attention--I think I would have asked something like "Since you knew your case lacked little if any evidence was your intentions during your visit with Jerry on Jan 18th to see if after praying with him you could get him to confess?" I would have also asked what did you pray about.

Would someone please inform Stafford, Brackett and the rest of the investigative team two things: 1) rape kits are not used only to prove rape but are also used to prove prior sexual activity, consensual or otherwise; and 2) not all intimate sexual activity involves assault. I am curious to know how anyone can look at a body that was dead for at least 2 and possibly up to 4 days and tell by looking that there was no sexual assault or activity. Unfortunately for Emily, I truly believe that she was playing with fire and she was fatally burned. I do not believe that Jerry Anderson committed any crime. Thus far, the only factual evidence that the state can prove beyond a reasonable doubt is that Emily Anderson is dead. The state cannot prove where the crime was committed so as to establish jurisdiction. No one thus far knows where Emily and the truck traveled from December 29th until the day the truck was moved from the parking lot in Duncan, SC. Everyone assumes that she was killed in either NC or SC but in the length of time she was missing she could have traveled anywhere - including Texas. Dallas is very conveniently located between Sawmills and the Mexican border which tends to be a popular jumping off point for some who are here with more than one name, more than one social security number and more than one alias. Emily was either the most unfortunate person I've heard of or the poorest judge of character when it came to matters of the heart. It's been my experience that people do not typically marry 5 times because they love getting married and divorced. Emily's own attorney testified that Emily said that Jerry would not listen to her but would turn of his hearing aids so he couldn't hear her. Sounds like a great way to avoid confrontation - not a pre-requisite to murder.

Had the theory been true that she left on her own and been in a hotel in Duncan with a man, wouldn't the rape kit have shown whether she would have been with a man prior to her death? And since she told her divorce attorney that Jerry and her hadn't been in the same bed in a month or so wouldn't that have been some crucial evidence that would have pointed the finger at someone other than Jerry? I don't know the extent to which those rape kits can show activity prior to death but that seems like a pretty valid question to ask.

I don't see how Dubs herself could possibly be reading this blog in the middle of this trial.. that's a little far reaching. I'd say she's got bigger dragons to slay.

JM did mention that Jerry was reading something off Campbell's PC. Think about the advertising opportunity for JM if lawyers are reading her articles during court! I agree highly unlikely, not impossible in today's technological world. As far as the dragon goes, doesn't there have to be a dragon before you slay it?

Still.. I think it's a little presumptious to think this blog is being read during court. Perhaps once the day is done.. but I'd think that during court.. the defense is paying pretty close attention to the matter at had.. Dragon that it is..
