Defense continues questioning into investigation

Sgt. Brian Bennett remained on the stand all day. He'll be on the stand tomorrow morning, too. Lisa Dubs will continue to ask questions. This afternoon she seemed to go over and over the same questions. I don't know if she is trying to drill the information in the jurors' heads or trying to fool up the witness - or both. I think it's frustrating to some folks in the courtroom. The room cleared out this afternoon (for whatever reason). You could hear some huffs and puffs when Dubs asked a question for the third time, just in a different way or asked information she asked earlier in the day. I'm sure it's just her job, though. I can't tell what the jurors are thinking. They look forward. They watch Dubs or the witness. Occasionally, they will write a note down.
So this afternoon just continued Dubs going over Bennett's investigation into Emily's disappearance and then after her body was found. Bennett testified he went to a McDonalds in Denver to follow a lead Emily may had been there, but there were no signs of her on a video tape. Dubs asked if he took a photo of Emily to ask folks around that area of Denver, he said no. Nor did he take a photo when he went to Sams Club. But Bennett said he did not see any signs of Emily Anderson on the tape. He didn't follow up on getting a subpoena when an SBI agent said he could check into Emily's email accounts, if he had a court order. Bennett didn't know if anyone else got a subpoena for that information.
The afternoon ended about the conversation Bennett had with Dr. Gardner, who did the autopsy on Emily Anderson. He had written in his notes that Gardner said time of death could be up to 10 days but more than likely two days.
Questioning will began again tomorrow at 9:30. I am not sure what the day will hold. Earlier this week, they referenced bringing back the dog man tomorrow. I know Pat Thorpe, Emily's best friend from New Jersey will take the stand soon. Bellas said Monday, I believe, Keith Keen would testify after Hartley's testimony, but that did not happen, so he'll probably be back to testify soon. Bennett could take a large portion of the day. We'll see. I'll be back tomorrow.

This keeps getting more and more outlandish. I didn't think that was possible.

-The investigator had enough time to go to a McDonalds over in Denver, but didn’t have enough time to look at the video tapes from Duncan. Oh Dubs, I dare ya, ask him if he ordered anything while at the McDonalds.

- He asked people if they saw Emily, but didn’t bring a photo? How did that conversation go exactly?

“Hey, you see a middle-aged woman walking around here? No, okay, thanks anyway.”

- I keep hearing this talk about the Sams Club in Hickory. Are the investigators aware that there are TWO Sams club locations in Hickory?

- And what does that mean he never got a subpoena for the email accounts? Does that mean no one had ever checked the emails? Please say this isn’t so!

allison it seems as though you have a lot to say about a case that it FAR from being over. Sounds like to me you hope that he goes free so you can continue your relationship with him.

In one comment you said that you knew Emily and she wouldn't want this. This is really the first time that you have showed any sympathy towards Emily and what happened to her. If you knew her so well, then maybe you would also know what kind of man she was married to.

Just stop being so one-sided (mainly Jerry's) and remember who the REAL victim is!

I agree allison you talk to much aon the defences side. May be you should be in court holding Jerrys hand. He is the one that did it and no one will convince me other wise. Too many people believe he did it for it not to be true. Hang him high.

Let's leave the Caldwell COUNTY POLICE alone and let them do there job. This has a distressful time for them. It seems everyone is picking their investigation apart like plucking a chicken feather by feather. They lay their lives on the line everyday for all of us and we should remember that. And for God sake remember who they are fighting for. A very sweet lady that did not deserve to die like that. She was treated no better that one of his cows if they had died. Just dumped like a piece of trash.
How do you like that allison I can talk as much as you can and make more sense of it.

It is disappointing to know that the Caldwell County Sheriff's Department is not qualified to handle any cases more complicated than wife-beaters and drunks. I'm no expert, but it looks to me like Det. Bennett needs to quit eating and do his job. What exactly did he do for this investigation??? How much does a pen and pad cost? I'm sure the taxpayers would be happy to purchase one for him so he could take some notes. They might even be willing to pay for the gas it would take it get him to Duncan to look at some videotapes that may give us some answers. After all, that is what he is paid to do. They should put up a tent and charge admission to this circus

Last night while watching the news (I believe WSOC) a trial update said: "Emily's glasses were found on a table in one of the hotel rooms next to the Waffle House in Duncan SC" AND also the news reported: "That one of Emily's credit cards had been used two days after she disappeared" Did anyone else hear this?

And Allison, you may not mean to but you are really coming across as being Jerry's mistress in waiting.....I'll admit the Prosecution has not dotted every I or crosses every T in this case and I think this type of exposure is way over their heads. Heck, even us common folks can pick the trial apart...but stick your tongue back in your mouth, Jerry could be yours one day soon!

I disagree that Allison is coming off like Jerry's mistress. I think her posts bring out valid questions in this trial.

Also, did I read on another post that Bellas and Tutterow have NEVER tried a capital case?? Does anyone know if this is true??

Friend in Sawmills - Be careful how quickly you want to hang someone. If the Sheriff's dept had followed up on leads like they should have they may have found out what exactly happened to Emily instead of using theories propped up by weak crutches. And just because "Too many people believe he did it for it not to be true" doesn't necessarily make him guilty or mean that he did it. Remeber, billions around the globe don't think God exist but that doesn't mean He doesn't exist! I agree with you that the Sheriff's dept does put there life on the line and should be commended for that but it looks like in this instance they've ruined an investigation by jumping to conclusions, not collecting evidence correctly (if at all) and not following up leads.

I cannot speak for anyone else on this blog except for myself and I did not know either party (Emily or Jerry) but regardless of where you get your story about this trial from (this site or local newspapers)there is one known fact that comes to light, very poor investigative techniques from the start. It is all documented, poor evidence collection,poor or no note taking,poor follow up on leads just to name a few. I'm not placing the blame on Det. Bennett but it sure looks like up to this point that he his bearing the weight of this case on his shoulders. People this is a capital murder case--The burden of proof is on the state to prove beyond a reasonable doubt that the defendant committed this crime. I do not believe up to this point the state has proved that nor do I think if you were able to poll this jury right now that they feel the state has either.

ret-investigator has alot of good points, the burden of proof does rest in the hands of the state. And I also don't believe that so far in the trial they haven't proved beyond a reasonable doubt that Mr. Anderson did this.

For any of you that reside in Caldwell County you know how small this county is compared to other surrounding counties and the majority of their calls probably do revolve around domestic violence and petty crimes. I would probably bet that the Caldwell County Sheriff's department has either never handled a capital murder case before or that it's been a very long time.

My father use to be on the police force of Caldwell County and my husband is an officer and they both agree that the officers who are handling this case have made some very bad errors in their investigation and that they have deffiantely not used the skills that they were taught in their Basic Law Enforcement Training.

I honestly believe that if the state doesn't come up with something better than what they've put before the jury so far that Mr. Anderson may very well walk away a free man.
