Voice mail messages bring tears to some
Good Wednesday morning. This morning Brian Bennett continues his testimony on the stand. He is basically going through the day-to-day investigation he did into Emily Anderson's disappearance. Early this morning, the prosecution played tapes of the voice mail calls Emily received from the time she went missing. Bennett and Jerry checked her voice mail on Jan. 1. Emily had 14 unheard messages. Her mail box was full. Playing the messages from various people - two calls from Jerry, several from folks at the dinner party, friends and family members - had tears and sniffles from both sides of the courtroom. Maybe it was hearing Emily's voice on her voicemail. Maybe it was the dreadful thoughts resurfacing from that first night Emily was missing. Several voice mail messages were left in tears. It was obvious then and is still obvious now, people loved Emily. During the messages (and really for all of the testimony this morning), Jerry looked forward with his hands on his chin or stared down at the desk in front of him, sometimes writing notes.
Jerry's messages were brief. On around noon Dec. 29, asked Emily to pick up oil and fuel filters for the tractor. "Thanks a lot. See ya." Another one around 5:30 from Jerry said, "It's 5:30. I thought we were supposed to be at Ray and Jennie's at 6. Give me a call at the house." That were all the phone calls from Jerry Anderson that day or the next, at least until Emily's voice mail box was full.
A lot of Bennett's testimony has been corroborating statements from previous witness. Bennett testified to what Antonio Reyes said about seeing Emily and Jerry go into the woods and Emily not returning. He also talked about the death notification to Jerry. Bennett, too, along with Myron Davis who testified earlier, said Jerry didn't show emotions. It made Bennett uncomfortable, he said.
Right before break, Bennett was talking about interviews with Emily and Jerry's friends. I figure Bennett will be on the stand for most of today, if not all of today.

What? So the big "smoking gun" with regards to the all important oil filters is that Mr. Anderson left a voice mail for his wife to pick up more filters because he just changed one on the tractor and noticed he was running low. That is the big brouhaha? This somehow adds credence to the idea he killed his wife? What?
You must be kidding me. This is their "evidence"?
It seems we have all stumbled to this conclusion on our own. The prosecution apparently ignored real evidence like the rape kit and the video tapes. Yet they try to make a scandal out of meaningless tidbits like an oil filter and unmatched fingerprints.
I want to see the result of those soil sample tests. If they didn’t test them, this trial should be thrown out. If they did test them and no blood was found, this trial should be thrown out and a legal note made about cadaver dog evidence. If they did test them and Emily’s blood was found. I would finally believe in the guilt of Mr. Anderson. Let’s see the dirt on the dirt. I’m being pessimistic, but why do I already think we will be disappointed by the soil sample tests....

Why is the pictures of the Andersons on the main page different?
One pic shows them sitting side by side smiling at the camera.
The pics below is the same as the one above but it's a close up with Mr. Anderson cut out.
But the pic of Mr. Anderson isn't the same as the one above. It looks like a nug shot or something.
Why the difference?
I'm so confused--We have a victim who lost her life--a defendant on trial for his life--A Sheriff's Department on center stage showing a lack of experience in collecting evidence,chain of custody of evidence,sending evidence for proper testing and a host of other major investigative miscues. The prosecution in turn is trying their best to present the facts as best they can while throwing in more "late discoveries" and other witness tesimony they say is relevant to their case. We have a judge who is doing the best he can to keep the trial going but knows in his own mind this is a fiasco from hell and if the case goes to the jury based on what we have heard so far the defendant could walk and if convicted this will be overeturned in the appeals court. Unless there is something coming down the road we have not heard I for one do not see how a Grand Jury ever returned a true bill of indictment in this case to start with. We can only hope there is more to this than we have heard so far.
The big "smoking gun" about the oil filters is that Jerry Anderson went to one of his Hispanic workers shortly after Emily disappeared, and asked him to change the oil filter AGAIN, and back date it to Dec. 29. Anderson also told his worker that if anyone asked, Anderson was helping him change the oil filters all day that day. Innocence people don't fake alibis. I think that he called and left the message about the oil filters on Emily’s voicemail to make it look like he was changing them.
As for the fingerprints again, there were NO usable fingerprints. What do you not understand about that?? This is not Law and Order or CSI. They did run the fingerprints through a national database so that they could answer to people like you, but there was not a match to be found because the prints were not usable.
THANK YOU Know The Facts! There is so much more to this case and trial than what is being reported in this blog. Remember, this blog is just one person's recap of what they have understood and can remember about hours of testimony-all summarized down into a couple of paragraphs. We can't assume that we understand everything about this trial and make judgements just from what we read here. Let's not get our panties in a bunch, everyone.

I heard no testimony to that effect. What the worker testified to was:
“Anderson asked him to change the oil filter. Garcia said he thought that was strange since the oil filter had just been changed and they cost $100 or $200. Garcia could not remember what date that was. “
Nothing about back dating the event to Dec. 29th. Nothing about saying Mr. Anderson helped. You are making that part up in your head and spewing it here as fact. In my view, you have lost all credibility.
And do you really think for a cunning man who supposedly made phone calls to his already dead wife, he would resort to the old oil-filter-change-the-date alibi trick. Huh? You see that an episode of Spy Kids?

And the person who testified he was told by Mr. Anderson to say he was with them was also the same person who received 49 phone calls from Emily in the month before the crime. The same person whose name is.... well... we’re still not quite sure what his name is, are we?
The back date the oil filters came from the same lame newspaper as the cops in Caldwell County....The Lenoir News Topic....Hearsay I might add,from a newspaper that is a day late or more in reporting anything...Including the events of 9/11...If it were true that testimony would have been given every time Antonio Reyes was on the stand...By the way Mr. or Mrs. Justice person I do not watch idiotic shows like CSI or any other....I use common sense and I do not judge ones guilt or innocence...Thats left up to a jury of our peers. What if this was "you" on trial...You would be smiling....
