Oh, boy!
Well, for a minute there, I thought this case was going to be over. The defense did not have any questions for Pat Thorpe. The prosecution rested, and then the defense asked for this case to be dismissed. Robert Campbell argued that the state did not prove its case beyond reasonable doubt. He said the state did not show a clear motive. Prosecutors did not show any DNA match, no murder weapon and no eyewitnesses or clear fingerprints. He put up a good fight. The prosecution argued that they had put up enough evidence and it should be up for the jurors to decide. Eric Bellas argued the Hispanic workers saw them go into the woods; two people heard gun shots; and no one saw Emily again. Nor, did Emily ever call anyone again. The judge must have agreed with the state. He denied the defense's motion to dismiss the case.
We are, however, done for the day. The defense will begin its case tomorrow at 9:30. I'll be back then. What an incredible interesting morning.
Oh by the way, I guess the prosecution decided not to call back Keith Keen. I know I mentioned him several times as the next witness. He was in court several days. The prosecution even said they planned to call him. So, I guess we won't hear his testimony, unless the defense calls him. They questioned several times to investigators why Keen was even involved with the evidence or crime scene processing or anything, when Keen was not a law officer, just a citizen. I don't know.

Nothing surprising about this--The decision of the judge is not surprising either--He is more or less protecting himself in this one by allowing the case to move on--He is putting the trial in the hands of the jurors--Kind of takes the monkey off his back. The state wins somewhat because by the judge allowing the case to move on puts in the minds of the jurors that the defendant may be guilty because the judge felt there was enough evidence presented (flimsy to say the least)to move on. Does that make sense? Just my opinion.
Based on what I've seen in the papers and on the blogs.. the state doesn't really have much of a case. I'm sure the jurors are seeing that too. I keep thinking that at this point in the trial, there would be a lot more people thinking Jerry is guilty. After all.. the state had just given us their best shot. Although, I think the defense's case will be very interesting. Dubs and Campbell seem to have done their homework.
Yes, I agree the defense will have a very intersting case to present-also the jury will hear the defense statements last-as we all know last "statements" seem to stick in the mind better.
I heard that at one point when they were seating jurors that Dubs asked the jurors what they would think if after the state rested if she didn't call a single defense witness. From what's been presented so far sounds like she could do that and probably Jerry would be found not guilty. I think that the first part of this trial has been a slow, easy pitch to the defense and they are about to knock it out of the park (i.e. do what they are paid to do by their client). It will definitely be interesting to see what the defense brings up to dispute the state's case.
I’m hoping the defense gives us answers to some nagging questions. For one thing, it will help cement Mr. Anderson’s freedom. But also, and I think at this stage more importantly, it might help lead investigators to the real killer.
- What did Emily buy from Victoria Secrets and very important, when? And was the item ever located in her house?
- Who is Bill? Why hasn’t he come forward?
- I want more details as to exactly where in Dallas that phone call originated.
- And so important and so easy and yet still not answered, who rented the hotel room where Emily’s glasses were found.
I have been keeping up with this and have not commented as of yet but I do have one question. Wonder why the prosecution decided not to call Keith Keen? Do you think that they have had a "joke" made of every other witness and knew that they would tear Keith apart? I am sure that in the good 'ol boy detective work that has been done on this case he was right in there with both hands. I would have loved to see Dubs go at him and what all he did and didn't do when the truck and body where located at his shop.
As ret-investigator says, no big surprise about the Judge's decision. The defense can renew their motion to dismiss at the end of all the evidence. With all the time this jury has invested already, Judge will likely give them the chance to make a decision based on what they have heard thus far. Judge Cayer is a former prosecutor and recognizes a well prepared DA and a slam dunk case when he sees it. Emily's friend did little to help the DA's cause. If Jerry Anderson threatened Emily as described why didn't Emily seek a domestic violence protective order or take criminal charges for communicating threats. She already had an attorney who would have advised her to do just that. Even the attorney failed to testify about being told of such threats. Why would any reasonable person tells someone who is outside the legal community and several hundred miles away about these kinds of threats and not report them to the local authorities? Either Emily falsified the truth to justify her leaving yet another marriage or her friend is making one last and desperate attempt to save a dying case. I am interested in seeing whether the defense puts on any further evidence.
I am sure they did not call Mr. Keen as he would be a joke for the Prosecution's case. Why did they have a tow truck driver collecting evidence?
And Observer of the obvious-yes,this question was presented to the prospective jurors (I was one of them-almost made this trial-thank God I didn't-I would have probley stood up by now and yelled-what a circus this is). Anyway, Lisa Dubs did ask the question of how would I feel if the defense called no witnesses-I found this odd and still do. I'll bet anything their entire witness list has adjusted.
And another note: I believe Jerrys defense team is court appointed-meaning you & I are paying for the two lawyers-private investigator

Keep in mind you haven't read nor heard any of the arguements that were heard only by the judge.
Also were you released early or later in the jury selection. I ask this, so you can answer another question what is the ages of the jury, occupation and so forth if you know?

hello, a friend told me about all this chatter taking place at this blog, and I thought I would check it out. He was right, what a pack of nuts you are. Do any of you believe in God? That thru Him all things are possible. If this guy (Jerry) is innocent it will come out if not he will not only answer to the law but to God too. And from what I gather in your chattering you all seem to think that the Caldwell Police have failed miserably. Not so, they have brought up some good evidence and they have done their job. So please quit riding them so hard.
Question; DO YOU HAVE NOTHENING BETTER TO DO THAT SIT AROUND AND GOSSIP? Why don't you try reading the Bible, It has something for all of you.

Does anyone know if the rules of reciprocal discovery applied in this case? I would think the defense would have wanted to give the prosecutor all of their documents and witness statements ahead of time in an attempt to get the charges dropped. It would be great if the defense helped out the state in finding the real killer(s).. but obviously that's not the purpose of this trial. The defense is going defend Jerry. I hope we aren't all disappointed when our questions aren't answered at the end of the day. If the answer to some of the questions posed here don't help Jerry.. you can bet you aren't going to get an answer for them.

The Caldwell County Keystone cops have screwed up,Ray Charles and Stevie Wonder could "see" that even...The prosecution has rested their case because they had nothing to begin with...I hope Ms> Dubs does'nt call any witnesses, she does'nt need any. The State has not proven beyond a reasonable doubt that Mr. Anderson is guilty....

At first I was one of those that screamed GUILTY,but now not so sure,thanks to all the poor work done on the case to convict jerry,a group of housewives could have done better!
