Deliberations will continue tomorrow

Well folks, another day without a verdict. At least we have some idea of what's going on behind closed doors. It seems they are deadlocked. It seems some jurors refuse to deliberate any more. When they came in just a few minutes ago, they didn't reveal too much emotion. They looked tired and some looked even frustrated. I can't imagine how frustrating it is. By the way, the foreperson is a female, and the retired cop that has been mentioned, I was told he was excused during jury duty, so he is not in the jury box.

We will be back tomorrow at 9:30 a.m. Will anyone change his or her opinion? Or will this end with a hung jury?

Hung jury tomorrow before noon. And nose, I believe it's over for today according to the latest posting. (This posting)

My question is, "Will the judge set bail or will Jerry stay in jail?" If bail is set, will it be affordable of perhaps 1 or 2 Million dollars?

I kind of feel like it may be deadlocked with some saying not guilty but with one or two hold outs for guilty. I am feeling the majority are going with not guilty. I may be reading more into JM's post but it seems that the judge is stressing the based on evidence presented. Does anyone know if the judge is allowed to have a count of who is voting which way? Also, are there any other steps that can be taken to help with the deliberation?

I think the Not Guilty & Guilty is split close to even 6-6 or at best 8 not guilty 4 guilty. I also think the "the OJ trial" may be in some Jurors minds, remebering how upset they themselves were when OJ got off. Even though they don't live in Caldwell C. they do have friends and neighbors who know they are Jury Duty.

A poll of the jurors as of right now is only allowed to be known by the jurors themselves.If the trial ends in a hung jury then the Judge can ask for a poll to be made known to the courts.
In the case of a hung jury the defense team will ask for a bail hearing if the prosecution seeks to pursue the charges. If a jury poll shows that it is hung in the favor of not guilty I think the prosectuion will think twice about pursuing the case...In my own opinion they are hung in the favor of the defense..From statements made we know it is more than one juror, I will say three at the most and they are probably women...

Judge can not / does not poll or ask for a head count among the jurors while they are deliberating. When he gives the case to the jury, it is truly in their hands until a verdict is reached. Judge only responds to questions from the during as they decide. He does not try to decide outcome of case.

That being said, a sheriff's deputy is usually outside the jury room and may hear conversations and have a feel for what is going on. Might report that to the judge for informational purposes but judge doess not influence the decision.

Well what a day still no decision.The jury has a real load on their shoulders.Maybe a hung jury would be the best at least if JA is guilty, I have no opinion whether he is or not. If he is at least the State or FBI could investigate more to determine if he is guilty whereas if jury comes back with anot guilty verdict,he can't be tried again. Justice needs to prevail for this cold,ruthless crime. It would be sad to see a innoncent man to die or a guilty man walk,anyone have a response to this.

I agree pineman. None of us know if he is guilty or not, but we all want justice either way. I too would hate to see an innocent man punished or a guilty one set free. I am so thankful I was released from this jury pool. I would hate to have thiat weight on my shoulders.

The jurors who are following the law and the presentation of evidence are holding out for "not guilty". The people, just like those on this blog, who are following their "gut" feelings are holding out for guilty. I don't see how there can be more than 2 or 3 holding out for guilty. The law is clear and the defense presented ample evidence to provide for reasonable doubt. Bellas pulled a lawyer trick with his closing statement because it knew it was the only way to even have chance. He presented a "theory" with absolutely NO evidence to back him up. He waited until the closing statement to give that theory because he knew the defense wouldn't be able to make him accountable for it. The smart jurors have seen through him, the emotional ones bought his BS hook, line, and sinker.

Dirty pool really, to present his theory in closing arguments, no opportunity to challenge...rediculous in a murder trial.

I think we can see what the jury is experiencing by taking a look at this meesage board...
We are largely divided in our conclusions just as the jury likely is.
If we take a look at the problems we have all had in simply following this case and submitting opinions it becomes clear that this case is at best vague and very hard to prosecute to a Murder in the 1st verdict.
But, moot as it may be at this point, manslaughter would have likely locked him away for good.

I have no emotional connection to the case whatsoever, just see a difficult case to prove
- beyond a reasonable doubt -

Like us, they obvioulsy won't be coming to a unanimous decision.

You seem to know a lot, on the insurance, will the banks get their money anyway no matter what happens in the trial.

James, it's my understanding that the bank has already taken all the farm equipment, animals, etc. from the dairy farm and it's been sold to pay the debts. If the jury comes back with not guilty and the insurance does pay, the banks can try to get renumeration but I don't see that happening. The banks liquidated the business. If they made a bad loan not backed up by collateral, that's their loss. If he's found guilty, there won't be anything for anyone.
