Repeat of the instructions
The instructions took about 15 minutes. The jurors are back there deliberating now. They have about 45 minutes before the judge says he will break them for lunch. Will we have a verdict by 12:30 or will this go into the afternoon? I wonder why they wanted to hear the instructions again. Maybe they are real close to a decision.
So, the instructions are simple. Cayer reads from sheets. He said reasonable doubt is based on common sense. He told the jurors it is their opinion what to believe a witness says, and he told the 12 jurors (alternates were not present) they are not bound by expert witnesses. He told them they cannot hold it against the defendant if he did not testify. Cayer told jurors they must be completely satisfied, beyond reasonable doubt that the defendant committed the crime. If they have reasonable doubt, they must find the defendant not guilty. Cayer also instructed the jurors not to consider the death penalty. He said that would be decided during a separate hearing and should not be a concern now. "It is your solemn duty to let the verdict speak the ever-lasting truth."
I will either be back at lunch or earlier - if something happens. I'm watching the red light.

I been reading about this from the start. I have tryed to keep up as much as i can. Iam really having a hard time with the time the jury is taking to decide this case!If this man is convicted and sentenced to death with no evediance aginst him except here say from imigrant workers who would say anything to keep from getting deported back to their country(not bashing mexicans!)would be a disgrace to our justice system.I have no opinion as to his guilt or lack of.

My thoughts exactly David! Even if Mr. Anderson is guilty, it was NOT proven beyond a shadow of a doubt. Unless the jury knows something we don't, I see no way that they can convict him on what little evidence the state has presented.
The jury knows about the same as we do Lneoirlady .
I think the Mexican is a US citizen. So I doubt if he was worried about being deported. You might check with someone in NC, but I believe I read or heard him say that he had worked on the farm for 8 years. But a Mexican is no more apt to lie that a person seeking 15 minutes of fame. And most are Catholic and are taught not to lie.
hey guys...I know I just came into this conversation but I have been following this case since it happened and have been following this trial since the beginning...my opinion is there is NO WAY the state proved Jerry did this beyound a reasonable doubt-are you kidding me?? There are way too many unanswered questions to possibly send a man to die. It is the STATE'S JOB to PROVE their case, NOT the jurys job to "figure out" what happened!!!!Am I wrong or is that what Bellas told the jury? If there are some jurors voting guilty THEY are voting from emotion and not the evidence.Just my opinion.
WEll this is my thought on the matter. I dont think they have proven anything, and only Jerry and God knows if he did it or not.I and many people in caldwell county thinks he did it but the evidence has been destroyed,never found etc. It looks like another OJ case to me.Not many husbands would have sat down for dinner that night and not went and looked for their wife.But again thats just my thought. If he is really not quilty then he is a very thoughtless husband.
