Deliberation breaks for lunch
Well everyone, I wish I had something interesting to tell you. There is no decision. The only decision to decide upon now is what's for lunch. I heard Western Sizzler and Tequilas (a local Mexican restaurant) discussed among everyone in the courtroom.
We all just wait, still. It's been more than six hours of deliberation now. I am leaning toward a hung jury, but you never know. Most likely if the jurors come back and tell Judge Cayer they can't make a decision, he will remind them of their duty and ask them to come to a conclusion - at least that's what happened in one other case verdict I've covered.
I will try to write something this afternoon. More thumbtacks needed or maybe a stapler or sticky pads. Seriously, hopefully, we will have some type of verdict this afternoon. Despite the seemingly upbeat attitude folks in the courtroom have, everyone seems to be anxious for an answer. Jerry seems positive. He's smiling, talking to his attorneys, sometimes laughing. The last three days, he has sat in between his council. During all testimony, he sat on the outside, beside Campbell.
Well, the jurors are getting the usual instructions - don't discuss the case outside the jury room, do not listen, read or watch any media coverage, and don't have any contact with anyone involved in this case. The jurors look, well nothing, maybe tired, like they are working hard. I bet they are working hard, at least I hope so. This is a big decision. I'm glad there doesn't appear to be any rush to judgment.

JM--You are correct--If the jury comes in and tells the judge they are deadlocked (hung) he must explain to them their duty and most likely will send them back to the jury room at least once to try and resolve their differences. If they come back and say they are still deadlocked(hung) the judge will most likely ask the foreman of the jury if he feels they cannot reach a verdict and if says yes then you have a hung jury. I cannot remember if the jury comes back hung does the judge have the jury polled. I think if the state or the defense ask for the jury to be polled then the judge could ask, I'm just not sure. It's been awhile since I was in a courtroom.
Anybody...If you were in the jury room, what would be your argument for a guilty verdict?

Why are people so quick to condemn a person ? Who in this blog has the right to truly say that Jerry did it ?
I agree with sawmillman. No we don't know for sure that Jerry did it. Please don't speak for everyone when you state your opinion. We are all entitled to our own. Thank you
The facts are cardboard there is no logical argument for a guilty verdict. I'm not saying he didn't do or he did do it . I'm just saying the state had a very weak case ! Not enough to convict a man and sentence him to DIE !!
as you said everyone has there own opinions and yes the state did a sucky job but if it had been done correctly I believe we all would see he did it
I agree with sawmillman - I don't believe he did or did not do it - there just isn't enough evidence to totally convince me to possibly sentence an innocent man to die. I would also not be able to go with a hung jury and thank about the fact if he is innocent, making him sit thru all of this all over again. It would be awful to be sitting there an innocent man and having to hear all of this and think that maybe your wife was fooling around on you and something went terribly wrong where they had to take her life. On the other hand, if he is guilty, her family shouldn't have to sit thru all of this pain again. I don't want a gulty man to walk but I don't want an innocent man sentenced to die. So what do you do? If I was a juror, I would have to go with "Not Guilty" b/c there isn't any evidence to tell me to convict him. Just opinions.
If he is found guilty and given the death sentence,chances are he will die of old age before he can be executed.I feel he is guilty and hope that the jurors come back with a guilty verdict.Common sense tells you that he is the only one with anything to gain from Emily's death.Is the defense is so sure she left town with another man,there where is he and why did they (the defense) not try to find him?They were so quick to point out the prosecutions and the CCSD's lack of evidence,but they haven't proved any of the claims THEY made.
Lenoirgal it is the prosecutions responsibilty to prove that Jerry is guilty. If there is a possibilty that there was someone else involved it is the STATES responsibility to find that person. Which the investigators never done . They only looked at one person the whole time !!
What I's saying is ,IF Emily had left with another man does it not stand to reason the DEFENSE would want to find him to show that someone besides Jerry could have a motive for her murder? Finding this guy would only help Jerry's defense,not the State.

one question, can anyone answer. IF Emily was cheating, don't u think his # would have came up on the phone records? she would have had to talk with whom ever somehow? I just don't believe that there was a somebody else, the only somebody i believe, was the one that helped Jerry. My opinion, & i wished we could hear something more....
If the judge was so convinced that Jerry was guilty that he wouldn't release him on a bond all those months ago how could it be possible that he would walk a free man?
i don't think he did it. Or atleast the prosecution didn't provide enough evidence to convince me he did it.
If he does get off on these charges can he seek retribution for the time he was forced to stay in jail?
I understand your point, how did EA communicate with someone else, but who was the man with the mullet hair style that was seen getting into her truck with her driving at the Holiday To Go the day she went missing? Has anyone else thought it was strange that the lady at PD Grocery testified she seen EA with khaki pants, tucked in shirt and brown loafers on the morning she went missing and she made the comment to EA about her being all dressed and she just said she was out running some errands. She was found in jeans and a sweatshirt, what Jerry reported last seeing her in. Has anyone thought to go back and re-question the lady at PD Grocery who testified about EA being all dressed up?
I still would hope that all of you bloggers who know for a fact that he did it and is guilty would come forward and bring your proof that can be argued in court to the DA, if you are not going to do that for yourself do it for the memory of Emily. Do it for her Family. Let’s get Justice done. The Defense sure did their job in bringing proof to the table; they proved beyond a reasonable doubt that he couldn’t have done it.
yes, i would like to know if the PD lady had a connection to Jerry. it seems too impossible to me that she could have worn the same clothes both days, last time she was seen & the day she was found. that don't come even close to being a coincidence to me, just impossible. i also wonder what was the reason Jerry gave when he was questioned about why he wanted the mexicans to lie about the oil filter & about washing the tractor. Does anyone know if the man that washed it saw anything unusual on it or was he even asked? R they any where to be found, i haven't heard of them lately. if u believe in psychics, the one in granite told there was 2 mexicans involved & their in mexico. just heard this, thought i would throw it out there & give something to read!
Does anyone remember awhile back in the paper when the trial first started they talked about a mexican employee that had been fired maybe September or October before Emily went missing? The paper stated he had ties to Duncan, SC and drove a brown SUV and that no one had been able to be in contact with him. Maybe he blackmailed EA to coming to Duncan, SC, kept her around and then when she decided she wanted to go back home and not go with him (he could have been fired for liking EA, you just never know), he then killed her, knowing to kill her somewhere to get her dirty to look like she was killed on the farm, and then he calls Antonio, tells him to do whatever to pin all of this on Jerry and he will give him some money. The mexican made his way to Mexico but first made a call from Texas to tip authorities off about her truck being parked at the Waffle House, after making sure Antonio had his stories down and enough to back it up. Anything is possible at this point.
I do not know jerry nor did i meet Emily but this whole trial is a mess because of gary clark and his crew of ignorant detectives. All this bunch knew how to do was to chase and nail a drug dealer.
As usual, the CCSD was in way over their little pointed heads. My grandpa, whose parents were murdered in Caldwell County in 1959, by the way, always said if you want to kill somebody and get away with it, drag the corpse to Caldwell County.
We can tell by how long it is taking this jury to decide their verdicts that they must be morons.

ANYWAY... FOR THE SAKE OF JERRY AND EMILY'S FAMILY I FEEL THERE WILL NEVER BE AN ANSWER. I CAN'T SAY JERRY DID OR DIDN'T DO IT. BUT, LOOKING AT EMILY'S HISTORY SHE WAS ON HER 6TH OR 5TH MARRIAGE, LOST COUNT IN ALL THIS. MAYBE IT WAS ONE OF HER EXES SHE WAS SEEING OR THAT DID IT.
SADLY TO SAY CCSD AND OUR WONDERFUL DA DID NOT DO A GOOD JOB IT WAS JUST ELECTION COMING UP SO NAB THE HUSBAND (OR WIFE VICE VERSA) JUST TO MAKE THEM LOOK GOOD.

Please allow me to aplogize for my remarks concerning the jury...I was out of line.
But I stand by my previous posts. Here in Caldwell County we have the laziest, sorriest, and most inept law enforcement in the State if not the Southeast.
I would not fear the law here if I decided to commit any type of malfesence.
Might I say Mr. Gary Clark's name needs to be left out of this!!! It is not Mr. Clark's detectives it is the CCSD detectives. Mr. Clark is perhaps one of the best sheriff's this area has ever had. Leave his name out of it for his family
so Emily did have access to a computer? If so, how dumb of the ccpd to not check it. omg, they can get everything outta one, even if it's been erased. that could have been key evidence, common sence would tell them to chk it, gosh, how embarrasing on their part to know that it wasn't even taken into consideration.
Goshdarn for some reason you have a real problem with Caldwell County Sherriff's department for some reason. I feel that Gary Clark got more accomplished in the few years that he was sherriff then Hutchinson did in his 20+ years as sherriff. I agree that the CCSD made mistakes but not every deputy there is as sorry as you claim them to me. My father was once a police officer as well as my husband and I don't care how you feel about them, they deserve your respect because they get out there every day and put their lives on the line for un appreciative people like you.

Quiet observer, I believe you are incorrect on the point concerning emails. Testimony shows the investigator said the email was never checked because he thought someone else was going to file for a subpoena. So no, the email was not checked.

"He [Bennett] didn't follow up on getting a subpoena when an SBI agent said he could check into Emily's email accounts, if he had a court order. Bennett didn't know if anyone else got a subpoena for that information."

What is the matter with you all?No one is really paying attention to what is said about this case. You are just guessing and making up things that have nothing to do with the "real facts" in this case.
He was the last one seen with her, he had his tractor cleaned and that was not normal at all. He carried a black garbage bag back into the woods where he left her.
He had his workers lie for him, He kept asking the law about EA's cell phone. And the list goes on.
The Caldwell County police were not under pressure to solve this case. I think the defense was reaching for straws on that statement. Backoff all of you talking bout our police, you have no idea what they go through on a daily bases, just puting up with nitwits like you. They deserve better and I hope they find out who all of you are and write you up evertime they see you. The next time there is a bad wreck (God forbid) go check out who is out there first or when there is a nut holding someone and making threats that he going to kill that person, who is it first to arrive to the sene to try to resolve the situation. Thank God for them, for they have the guts to do it , have you.

People have made staements in here.Everyone has their opinion of others including you.We as a whole have to learn to live with that.We cannot change opinions of other people,it makes the world a diverse place to live in. Which is why we have free speach laws in this country.I,being from a family in law enforcement for generations would be the last to condemn them.But when I see shoddy investigation I recognize it and would tell my own family members so...Honesty in my opinion is called "tough love" as brutal as that may sound.This blog is for conversation and opinion,not to condemn people based on their view.I wonder if you have ever used the words "trailer trash" in your vocabulary???
I actually think there were 2 or 3 people involved in the murder, the 2nd is long gone for now. Re: phone call from Texas telling location of EA's truck, unknown fingerprints under the tool box lid. If there was a #2 & #3 this could go back to trial with JA charged with conspiracy to commit murder. If she was killed in SC it could then become a Federal Kidnapping Case. If there is a #2 & #3 it could still become a Federal Case of #2 & #3 flight across state lines to avoid prosecution. JA could still be on the legal menu on various other criminal charges, not including civil actions by EA's relatives (OJ style). Even if JA is found Not Guilty he's still really close to the LEGAL WOODSHED. Remember the phrase about "more than one way to skin a cat?"
So. Here we are. It's obvious thhat the state did not prove their case against Jerry. No one here knows if he did it or not. Sure, many seem to have an opinion and that is good. The fact is you can't convict the man because it is your opinion that he did it. A man is innocent until proven guilty, not visa-versa. The bottom line is the state did not have the evidence to prove beyond a reasonable doubt that Jerry committed murder. Therefore it is the jurys duty to acquit,irregardless of their ,or anyone else's personal opinion.

I would LOVE to know the real identity of Allison! She obviously has a lot at stake in this and is not really interested in Emily or her family getting real justice. For heavens sake Allison, Emily was MURDERED. The the last person actually seen with her was Jerry. The testimony stating she was in khakis and a shirt proved not to be so in that she was found in what she was wearing when she went into the woods with Jerry!
It is sad to see that two families are suffering from this cold senseless murder of EA.Only EA,God and whoever did it really knows what took place whenever EA was killed.Ihope the jury makes the right decision concerning the fate of JA.Everyone here has an opinion but what we think makes no difference at all.If he killed her and gets by with it here because the State could not prove it he still want get by with it because we all will answer for what we do in the future before one that knows it all.One day someone will answer for the death of EA.If he is innoncent I hope he can walk so the CCSD can get busy and work harder this time with efficency and find the cold and ruthless person that has destroyed many lives with this cruel murder.Payday will come someday for this person.
By what I have read, it seems JA has had a lot of support from friends that believe in his innocence. I have read that he has several in attendance each day. I have not read the same about friends of Emily's. I am surprised more of the people who think he is guilty have not been in the court room on the prosecutors side supporting Emily's family.
