No verdict yet, just thumbtacks

Thumbtacks, ladies and gentlemen. For a minute there, I didn't know what was going on. I thought the moment could be upon us. Jerry came back in. The judge came back. But, the red light never came on. Turns out the jurors wanted thumbtacks, and Cayer wanted to put it on the record. Man, my heart started racing. What would you need thumbtacks for? Maybe the large map they have of the Sawmills community? I hope they don't poke each other. "I'm right." "No, I'm right." Poke.

I really hope a verdict comes back today. Do you think they would want to go over the weekend? I don't know, though. It seems they are taking this really seriously. They've been at it since 9:30 a.m. this morning. They went 4 hours and 15 minutes yesterday.

So, everyone is just waiting. Several folks are sitting in here, talking about life, reading the paper and just waiting... Folks are walking the hallways, just waiting. I sit here, surfing the Web, checking my email and working on other stories. Basically, I'm just waiting.

Well, I will be back later. Maybe next time they will go for something bigger like a push pin.

This actually may be bad for Mr. Anderson. There are probably a few hold outs on the Guilty verdict and the Guilty's are trying to convince. Didn’t someone say in a previous post that there was a juror on the panel that had a relative on death row? It is just odd to me that they haven’t come back with a verdict yet, based on all of the evidence that was presented by the Prosecution - this should have been cut and dry. Of course we are not there and I am sure that as well as JM did updating the court room blog we as bloggers did not hear everything. This is a wait and see, no really knows what goes on behind those closed doors. It is very interesting and true that you just cannot predict what a group of 12 will do.

The longer it goes . Usually the better it is for the defense .

Folks I can tell you that this jury being out this long is a sign that you have one or jurors that are not along with the others. I think the jury is leaning toward conviction and you have a few that are not willing to convict the man for his life. I'm guessing this will be a hung jury at this point unless the others can get them to change their mind and vote guilty. Just my thoughts.

My guess the reason for the thumbtacks was so the jurors could pin up the information they requested from the judge in some type of order so they could try and get a picture of the events as they took place and develop a timeline of those events in their on minds. Makes good sense to do that instead of sorting and resorting through that evidence and passing it around the twelve of them.

It's 12:08 PM--Has the jury taken a break or are they working through lunch?

Ret-Investigator,
I think you are correct. I see that the sawmillman thinks differently. But I actually think that the jury would have already returned a verdict of not guilty if someone or some of the jury wasn't holding on to guilty. It's good that they are taking their time. Just get it right the first time based on the evidence they have. Then the rest of us will have to accept the results.

re enough: I was just expressing an opinion about the order of evidence and trying to arrange it for their own viewing. Your comment about the thumbtack class deserves no response.

Ret - Just ignore. I would have to agree with you on what they are doing! I know that when they can organize a time line things are much clearer. I am really surprised that they are taking this long. Some are holding out and I dont know that they will be convinced. I know that if i were there I would not be swayed.

re soccerjox--I truly feel the spin Bellas put on his closing arguments has this jury trying to piece together what he said and see if if makes sense. What I do not understand is how they could even consider that story since it was never brought up at the trial at least from what I've read. Your thoughts?

Ummmm, I am surprised that the Judge did not strike that whole part, I am not a lawyer, and do not know if he could do that - how he could bring that up and use that in closing arguments without it being brought up in court. That wasn’t proven, wasn’t discussed? Is he going to pursue charges against the Latino as an accomplice? Did Lisa have the option of objecting a closing statement? When I read that statement after JM posted I was floored. I would love to know what Ms. Dubs thought when she heard that closing statement. What are your thoughts on that?

sawmillman,
I agree that a hung jury is far better for the defense than a guilty verdict. However, a hung jury is almost as good as a guilty verdict for the state. So if I had to guess which side gets the advantage from a hung jury, I would say it would give the state more time to re-investigate and prepare a better case. Not trying to argue. Just stating my opnion.

re soccerjox:
I think maybe that surprised the defense. I do not think the defense or the judge can stop or object to closing arguments. I could be wrong. I think he could have given any number of theories as long as they related to the case being tried--Just not sure.

I agree with sawmillman, the longer it goes, the better it is for the defense. In following this case, I've found that the prosecution's evidence has been thin, reaching, and, at times, improbable. I'm not saying the defense is raining gold, but I've just felt the prosecution was lacking, and therefore, seemed to be grasping at straws. Who knows. Hopefully, the jurors are level-headed and able to truly base the given evidence fairly and not just "go with their gut." I'm sure, if the jurors have taken this long, they're doing a good job at what they've got. Good Luck!

fireman-
How can you be so sure he is guilty? I don't believe that EA was killed on the farm. Too much has been said from witnesses in SC about seeing her alive and how can someone argue with an autopsy report? If JA had anything to do with it, he hired someone to do it, I do not believe he actually pulled the trigger.
