Nothing new at the mid-afternoon break
Good afternoon everyone. It's time for the mid-afternoon break and no word from the jurors. I guess they are back there going over the evidence, debating further. Unless they are taking sports and food and movies, but I hope not. I think they want to come to some type of decision, but it sounds like a few are not going to change their minds. So now I ask, will they come back this afternoon and say we are still hung, or will we all be back tomorrow? Well, we have an hour and a half left in the day. Technically, we have one hour and 15 minutes. So, I did the math. We are at 29 hours and 15 minutes of deliberation. Wow. By the days end, it will be at 30 hours and 30 minutes. The defense and prosecution have said this is the longest deliberation either has waited. Interesting...
Well, we keep waiting. A lot of small talk, story telling and even some laughing. As long as we've all been waiting, you have to try to keep a positive attitude, especially those that are personally involved. I'm not saying we are taking this situation lightly, but you have to have a positive attitude or you will go crazy. Well, I will be back at 5 if nothing new happens, but you can bet I will let y'all know if anything happens.

I'm of the mind that the jurors might come back in today and say they are still deadlocked ! I think they are ready to go home . But i could be wrong .
What do the juriors say to one another after 30+ hours of deliberation. When it's 10 to 2 you have 84% of the jury that wants it one way and 16% that want it the other way. Can the 2 convince the 10 that they are wrong? Can the 10 convince the two they are right? I'm just trying to use logic to see if any of this makes sense. Either the two hold outs are going to change their mind by the end of the day or it's going to be a hung jury. That's my perdiction. What do ya'll think?
LARRY They may change there verdict . But i kind of doubt it Since they havn't changed it after 28 hours ! Just my opinion !

Whether its today or next month, given that we (in NC) don't allow anything less than unanimity from a jury in a capital case.
What a mess...
I advise you all that live in the area and that are affected by this to really take a hard look at your next election. Hopefully someone will come in and really clean house as a result of this investigation. However this trial ends, and whatever side of the issue you are on, work to better your Government, they are there for you, they in essence report to you the citizens of that community. You all should have some serious questions for this CCSD and the DA's Office regardless how this pans out!
I don't know if any of you follow the Topix board but I responded to Gertie who I believe was a friend of EA and is very close to the situation, I do not know JA nor did I know EA, what concerns me in this case is that the judicial system in this great free country we live in has become so overwhelmed with cases that are not properly prepared that people are in jeopardy of loosing their life. I want the system to work; I want all parties that work in the system to do their jobs. Imagine how easily it is to convict someone of murder and impose the death penalty based on circumstantial evidence? Regardless of how you feel about this case, that point should concern you. That should be a decision that is based on all facts; there should be no reasonable doubt in anyone's mind when this kind of decision is made regardless of which side your opinion falls.
Bellas should have never gone after 1st degree with this case. He could have attempted 2nd degree murder and most likely we would be through with this and there would be closure for these families.
I think a bigger problem with our court system is people who commit crimes and then get away with it. When you look at all the checks and balances, original cases, numerous appeals, the ability to be pardoned, rarely does someone get put to death who didn't commit the crime.
What is a problem though is individuals who commit a crime, murder in this instance, and are able to get away with a terrible crime because there is no smoking gun. I'm not pleased with the way this investigation was handled... many things should have been done differently. However, that doesn't change the fact in my mind that Jerry Anderson is a cold-blooded killer.

I'll note one more thing... let's say it was a perfect little world and we knew for a fact that Jerry was innocent... He still has cheated individuals and companies out of HUNDREDS of THOUSANDS of DOLLARS and he treated his wife like dirt. There is such a thing as karma... even if he was perfectly innocent, I wouldn't mind seeing him sit there and squirm like the little snake that he is.
Even if a person gets the dealth penalty in NC, they will most likely die of old age before NC will execute them. The person who murdered my family members has been on death row since 1991. That's 16 years, one of the people he killed was only 12, he has been on death row longer than she was on this earth.

Sawmills Citizen what you are writing is hearsay or rumors whichever way you prefer to look at it . I am basing what i write on the eveidece presented in this case . The prosecution had almost nothing not even a good theory . I don't know if JA did it or not . But that is not enough to convict someone of Murder In The First !

Saw mill citizen this trial isn't about whether or not Jerry "cheated individuals and companies out of HUNDREDS of THOUSANDS of DOLLARS and he treated his wife like dirt". This is a murder trial, and the prosecution did a piss poor job at proving he's guilty. If he did it and he's found not guilty he will pay for it one day. But based on the evidence I can't see a guilty verdict coming from this.
Also the people in here that are basing there opinion on a " GUT FEELING" I hope and prey Ya'll Are never on a jury. And i'm sorry in advance if that hurts your feelings but if it hurts your feelings then maybe you need to think about it .
I totally agree with soccer. I live in Caldwell County... what if it had been ME that was murdered? Is this the way I would want our law enforcement to handle MY murder trial? Or someone in my family? It isn't fair to Emily... OR to Jerry (if he's innocent). This is a disgrace to the residents who have lived here all our lives.

me*in*hud, I agree with you. I think he did it, but I think he had help. Even if he isn't the one guilty of 1st degree murder, I think he knows who IS. Either way, for Emily's sake, I hope and pray they find the guilty person and Emily doesn't just become another statistic. The family, and the community, need closure... and that won't come until the murderer is caught.
There have been two crime's committed here, Emily's death, and the rightful death of trust in the local DA/investigating teams.
Jerry may have been a "beast" to Emily, and a cheat, and God know's what else. I don't like speakin' ill of the deceased, however, if she was treated badly, she obviously had numerous friends and family she could have turned to...didn't she?
Plenty of people have robbed banks, but would never consider murder...and visa versa. Don't take your comfort from the fact that he'll pay for this crime, whether he did it, or not. Emily was a great all around human being, was she not? Would she have been like you? Would she appreciate her friends/family being so cut and dry? If Jerry is innocent, would she want him to lose his life....because he was a "beast" to her? You'll find NO inner peace from that.
I still believe she left of her own accord...trusted the wrong people, and paid the ultimate price for it. The evidence has lead me to that end...not my personal feelings.

A good source told me after Emily's disappearance her brother said... something like this - I don't know why you all are so worried - this is a typical pattern of Emily's...she will disappear for a while about every 4 or 5 years and noone knows where she is at...
We need to remember this trial is not to prove Jerry's innocence .. but whether he is guilty or not guilty. Base on what I have read the prosecution did not present enought evidence to the jury for them to find him guilty.
I keep considerin' the hairdresser's testimony. She did Emily's hair for the dinner party...blonde. Then when she did it for the funeral, she noticed it was darker. Someone who kills a person, while they might dress them in the clothes they were wearin' the last time she was seen, wouldn't think to alter the haircolor, seein' as men, being men, don't notice that kinda thing, without prompting, even on a regular day...nevermind a stressful "gettin' rid of the evidence" day.
Emily had her reason's for letting the hairdresser do the "norm". She knew anything else would bring about questions...if not from the hairdresser, then from the hostess/women attending the dinner party...if for some reason she didn't have a chance to duck out before the dinner party. Therefore, I have to conclude she redid it herself, after she was safely away...for the purpose of gettin' "lost in the crowd"

A lot of you have made excellent points (based on the evidence presented) for both sides.....I know most everyone wants this over but if a mistrial is declared, and it is decided to begin again, I hope both sides regroup and dig deeper. I for one feel that the families and the community both could have a more complete closure if there wasn't so many unanswered questions. If it ends like this then there will always be speculations and accusations no matter what the verdict.
By the way- does anyone know if the charges stay the same if JA is retried? Is it possible that the prosecution can seek a "lesser" charge like 2nd degree murder or manslaughter, like some of the bloggers have mentioned or must he still face the death penalty if convicted of murder one?
Just thought of a vital point...maybe. Regardless of the act, murder, or Emily just pickin' up 'n leavin'. It was well thought out. Sooooo: If Jerry is guilty of doing it himself, or with help, why would he dress her/have her dressed in the same clothes she had on the last time he and the employee (the only witness, in a country that automatically considers the spouse a suspect) saw her alive? Doncha think he'd dress her/have her dressed in something "normal for Emily", but yet nothing that would insinuate she had "never left his side?? Her haircolor was changed...why not her attire?
New haircolor, new Emily, new place's to be....same old clothes....makes ZERO sense to me.

Your comment reminded me of something that was said to have come from Jerry when Emily first disappeared....It was something to the effect that he was concerned that she may have stopped along the road somewhere to help someone who may have been in trouble or needed help. It was said his concern was that Emily was a very trusting person who was always ready to lend a helping hand and his fear is that someone had taken advantage of that.
Now - even though I live in Sawmills and attend DPBC I did not know either of them personally and this was second hand information from someone who claimed this was stated by Jerry. But I do remember the chills I got and how even now I am much more cautious when traveling alone, even "around here." Now on the flip side if (and I said "if" guys) Jerry is guilty and he wanted it to look as if this was a carjacking that ended horribly with Emily's death, then there would be no reason to change her clothes.
Something that nags at me though, is even if Emily decided to leave of her own accord - I don't understand how someone who has been described as such a loving, tender-hearted person (by SEVERAL people, I might add) would allow so many people she cared about to worry over her to such a degree. Especially with the media coverage her disappearance was getting. in fact if she were "running" from her husband out of fear then the publicity coverage could have actually helped her- I mean, once that was announced Jerry would have been "labeled" so to speak, and any future dispute between the two might as well be a matter of public record. I can't form an opinion either way at this point, I suppose time inevitably will tell.

There had to be a terrific stench emitting from that toolbox. It wasn't airtight, because testimony said there was blood under it. You'd think the patron's of that waffle, regulars, who probably stopped by there every day/night, would have smelled something "not right". You'd think when they located the truck, and there were cops/others standing around, doing the local investigation, to clear it for departure from their juristiction....someone would have gotten a whiff of something...wouldn't ya? Yet nothing was seen/smelled to be out of the ordinary. Hard to believe, huh?
It's been said here on the blog that Emily's brother said it was like her to leave. Don't ya think he'd be in hot water with the rest of the family (and ya know how news travels), if he just uttered that statement off the top of his head, and it wasn't a fact?
Normal, for Emily, was to run errands in her work clothes, as was testified to by the PD employee. That day, however, she was wearing dressier clothing. . When asked why she was "dressed up", Emily replied she was doing errands. She had begun tryin' on the "New Emily", imo. I doubt she took clothing with her, except for maybe what she had on when she left. If she had taken more, and she 'n Jerry shared a closet he would have noticed by that evening, or at the latest, the next morning, when he chose his own clothing for the day. He would then have looked in her lingerie drawers, through her make-up, shoe's etc, and know she had left, for good....but she needed more time than that gave her. I figure the $2000. that was stolen from her, was her "New Emily" fund.
She left Sawmills alone...couldn't chance being seen with someone who might be familiar to anyone she might run into. They took the truck out of South Carolina, but I believe they left her her killer(s)trail there.
According to information provided by WSOC-TV 9 out of Charlotte, Charlene Bauer, an employee of the Quality Inn Hotel located across from the Waffle House, said Anderson's truck “was sitting there with a right, front flat tire for over a week. I was wondering, “When are they going to fix that tire and get that truck out of here.'”
Another employee said a van with a man and woman in it pulled up beside the truck on Tuesday, Jan. 3, according to WSOC-TV's report.
“It was a brown van,” Betty Dillard said. “She got out...and she went to the truck. After she went to the truck, I don't know what she got out of the truck.”
If you were gonna leave the truck sit there, in a strange place, overnight, much less a week, would you not take all the valuables out of it?
Was it Emily? If not, who was it...and how did she get Emily's keys? Why would the killer(s), or the prospective killer(s) involve someone else in their crime? Can anyone think of someone missin'/gone, for whatever reason, during that time period?
If it was Emily, and she knew she was in a live or die situation, why didnt she run/scream FIRE or somethin', when she had the chance. Draw attention to herself, and perhaps the killer would have fled, rather than take the chance someone would be able to describe him? Better a moving target...vocal target, than a submissive one...doncha think?
